Website Terms of Use
40to60s.com is owned and operated by Purrfect Catio, LLC, a North Carolina limited liability company, d/b/a 40to60s Friends of Charlotte ("40to60sCLT," "we," "us," "our"). These Terms cover your use of this website — the pages, the event listings, the member community feed, and anything else we publish here. By visiting or using this site, you agree to these Terms.

How this fits with our other documents
40to60sCLT's relationship with you is covered by a few different documents, each doing a different job:

These Terms of Use — govern the website itself: using the site, posting in the community feed, whose content belongs to whom, and what happens if the site or platform lets you down.

Privacy Statement — covers what information we collect and how we use it.

Code of Conduct — covers how members and guests are expected to behave, at events and in the online community, and what happens if that's not followed.

VIP Access Membership Agreement — the signed contract covering VIP dues, billing, term, and cancellation, for members who join VIP Access.

Event Liability Waiver — a separate release signed before attending events, covering physical injury, property loss, and other in-person risks.
These Terms don't replace any of those — where they cover the same ground (for example, community behavior), the more specific document controls.
40to60sCLT is a community for adults. You must be at least 18 years old to use this site, create a member account, join VIP Access. By using the site, you're confirming you meet that requirement.
Who can use this site
Accounts and the member community
If you create a member account or join the Members Area / community feed (Wix Groups), you agree to:

Give us accurate information and use your real name and identity — no fake profiles or impersonating someone else.

Keep your login credentials to yourself and let us know at 40to60s@gmail.com if you think your account's been compromised.

Follow the Code of Conduct in everything you post, comment, or share in the community feed. That document has the full detail on what's expected and what isn't — these Terms just confirm it applies to your use of the site.
When using this site or posting in the community feed, don't:

Post anything harassing, hateful, discriminatory, sexually explicit, threatening, or otherwise inappropriate for a mixed adult community built on trust.

Post another member's contact information, photos, or personal details without their okay.

Use the site to solicit members for business, sales, multi-level-marketing pitches, or fundraising without our advance permission.

Post spam, scams, or anything misleading or fraudulent.

Try to access parts of the site or another member's account you're not authorized to use, or interfere with the site's security or normal operation.

Scrape, harvest, or otherwise collect data from the site or its members beyond ordinary browsing.

Use the site for anything illegal, or that infringes someone else's rights.
This list gives examples — it isn't the complete list of what we can act on. The Code of Conduct has the fuller picture of expected behavior in the community and at events.
Acceptable use
Our right to moderate
We built the community feed to be a good place to be, and we'll act to keep it that way. We can, at our discretion and without advance notice:

Remove, hide, or edit any post, comment, photo, or other content in the community feed or elsewhere on the site that violates these Terms, the Code of Conduct, or that we otherwise judge doesn't belong.

Suspend or terminate a member's access to the community feed or the site, for a violation of these Terms or the Code of Conduct, or for any other reason we reasonably believe threatens the safety or trust of the group.
Removing a member from the community feed or website under these Terms doesn't, by itself, cancel or change the person's VIP Access membership or refund rights — those are governed separately by the Membership Agreement and the Code of Conduct.
Content you post
You keep ownership of anything you post to the site — photos, comments, profile information, and so on. By posting it, you give us a non-exclusive, royalty-free license to display, reproduce, and use that content on the site and in our related promotion of the group (like social media), for as long as it stays posted or as reasonably needed to operate the community. You're responsible for making sure you actually have the right to post what you post — don't share someone else's photo or writing without permission.
If you'd rather not appear in event photos we post, let us know at 40to60s@gmail.com and we'll do our best to accommodate that going forward.
Our content
Everything else on this site — the 40to60sCLT and 40to60s Friends of Charlotte names and logo, the site's design and text, and any other content we (not our members) create — belongs to Purrfect Catio, LLC or our licensors. You're welcome to share a link to our site or an event page, but you can't copy, reproduce, or reuse our content, name, or branding for your own purposes without asking us first at 40to60s@gmail.com.
VIP Access and payments
VIP Access membership — including pricing, billing, term, cancellation, and refunds — is governed by the separate, signed VIP Access Membership Agreement, not by these Terms. Payments are processed through Wix Payments (or another processor we identify at checkout); we don't see or store your full card number. If anything in these Terms conflicts with the Membership Agreement on a VIP Access billing question, the Membership Agreement controls.
Links to other sites
This site may link to other websites (like a venue's page or a payment processor) that we don't control. We're not responsible for the content, policies, or practices of any site other than our own.
No warranty
We do our best to keep this site accurate and running smoothly, but it's provided "as is," without warranties of any kind, express or implied. We don't guarantee the site will be uninterrupted, error-free, or secure, or that event listings, dates, or details will always be current — always confirm event details before showing up.
Limitation of liability
To the fullest extent allowed by North Carolina law, Purrfect Catio, LLC won't be liable for any indirect, incidental, special, or consequential damages arising from your use of — or inability to use — this website or the community feed, even if we've been told such damages are possible. Our total liability for any claim arising from your use of the website itself won't exceed the greater of $100 or the amount you've paid us in the past twelve months for VIP Access.
This limitation covers the website and online community only. It doesn't cover, and isn't a substitute for, the separate Event Liability Waiver you sign before attending in-person events, which covers physical injury, property loss, and other risks at events themselves.
Nothing in these Terms limits liability where North Carolina law doesn't allow it to be limited, such as liability for our own gross negligence or intentional misconduct.
Indemnification
You agree to indemnify and hold Purrfect Catio, LLC, its members, and anyone helping us run the group harmless from any claim, loss, or expense (including reasonable attorney's fees) arising from your violation of these Terms, your content, or your misuse of the site.
Termination
You can stop using the site any time. We can suspend or terminate your access to the site or community feed as described above under "Our right to moderate." If you're a VIP Access member, ending your access to the community feed doesn't by itself cancel your VIP Access membership or dues — cancellation of VIP Access works the way the Membership Agreement describes.
Governing law and venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the site will be brought in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to that venue.
Changes to these Terms
We may update these Terms as the site and group grow. If we make a meaningful change, we'll update the "last updated" date above and do our best to let members know directly. Continuing to use the site after a change means you accept the updated Terms.
